Requirements

Before a marriage can occur in Tennessee, a license must be obtained from the County Clerk. The fee is $97.50. The fee is reduced to $37.50 if the couple completes a Premarital Preparation Course. There is no waiting period, the marriage license is valid for thirty (30) days from issuance, and is good for ceremonies performed anywhere in Tennessee.

  • Proof of date of birth (Certified Birth Certificate or Government Issued Photo Identification)
  • Social Security Number (for individuals that have been issued one)
  • Both parties must appear together. If either party is under the age of 18, contact our office for additional requirements. If either individual is incarcerated at the time, or has a disability which prevents the person from appearing, that person may submit a notarized statement.   • The fee is $97.50. Applicants who have completed a premarital preparation course within a year prior to the date of applying for the license are exempted from paying $60.00 of this fee. Applicants must present a Certificate of Completion completed and signed by the course provider. This document must be notarized and presented to our office at the time of payment and receipt of your license.

Requirements

Marriage Requirements:

  • Both applicants must be 18 years of age
  • Both applicants must be present to obtain marriage license
  • Present the following:

  1. VALID driver’s license, state-issued photo ID card, military ID, or Passport
  2. AND Social Security Card
    (if you are unable to provide your card you MUST know number)
    NOTE: If you are a non U.S. citizen a valid passport is the only documentation required

  • If either of you have been divorced or widowed, you will need to know the exact date that the divorce was final, or date of death. If the bride has a name change in her divorce and has not updated on her driver’s license, she will need to provide a certified copy of her divorce decree
  • There is no blood test
  • There is no waiting period
  • License must be used within 30 days from the date it was obtained in our office
  • License can be used same day as obtained at one of our offices
  • Fee for out of state residents is $41.00 cash, or if paying by card there will be a small processing fee
  • Fee for Tennessee residents in $101.00 cash, or if paying by card there will be a small processing fee
    • Tennessee Premarital Waiver: Sixty dollars ($60.00) will be waived if applicants complete a four-hour premarital course and present a notarized certificate of completion. This form can be obtained in one of offices or click here for printable versionOpens in new window.

Officiant of Ceremony: The officiant (person who performs the marriage ceremony) is required to return the signed documents within three (3) business days after the marriage (BLACK INK ONLY). Only upon the return of the signed documents will the clerk provide the applicants with their certified Marriage Certificate. The certified Marriage Certificate will be mailed to the address provided by the applicants. Allow 2-3 weeks after the ceremony to receive the certified Marriage Certificate in the mail.

Unable to appear in person

  • If either individual has a physical disability preventing them from appearing in person, the applicant may submit a notarized affidavit, click here to print form Opens in new windowor you may pick up at office locations. Additionally, a notarized consent letter is required by the attending physician on facility letterhead stating the disabled applicant is alert, oriented and aware he/she is seeking to obtain a Marriage License.
  • Sevier County incarcerated individuals (Sevier County ONLY) seeking to obtain a Marriage License may submit a notarized affidavit, click here to print form Opens in new windowor you may pick up at office locations.  Additionally, a notarized consent letter by the warden or chaplain on facility letterhead stating the incarcerated applicant has been authorized to obtain a Marriage License.

Marriage License Issued to Same Sex Couple
Effective June 26, 2015, same sex couples may obtain a marriage license and be married in the State of Tennessee.

Marriage License Prohibited Between Lineal Relatives
Tennessee Code Annotated “36-3-101. Prohibited degrees of relationship” states:
Marriage cannot be contracted with a lineal ancestor or descendant, nor the lineal ancestor or descendant of either  parent, nor the child of a grandparent, nor the lineal descendants of husband or wife, as the case may be, nor the husband or wife of a parent or lineal descendant.

CERTIFIED COPY OF YOUR MARRIAGE CERTIFICATE:

  • First you need to know what county you obtained your marriage license in
  • If you obtained your marriage license in another than Sevier County you will need to contact that County Clerk Office in order to get a certified copy of your marriage certificate
  • Please have the following information before requesting a certified copy of your marriage certificate:
    • Applicant 1 First and Last Name (last name at time of application)
    • Applicant 2 First and Last Name (last name at time of application)
    • Date of Marriage
    • Current Mailing Address
    • Payment information (if ordering online)
  • Visit our office/s: $5.00 per certified copy
                                        (if credit card is used a small processing fee will be applied)
  • Mail:                        $15.00 by money order or cashier check only
                                        (no out of state checks will be accepted)
                You MUST include all of the following:
    • Both applicant’s names (if either person/s change their name please include name at time of marriage application)
    • Both applicant’s Dates of Birth
    • Date of Marriage
    • Contact Phone Number
    • Mailing address
  • Online Certified Marriage Certificate Request:
    • $16.36 (credit card only)
    • Online requests for a certified copy of a marriage certificate are processed at the County Clerk’s office daily and mailed out via the United States postal service. Due to high volume of requests, please allow 15 to 20 business days (3 to 4 weeks) for delivery.

Marriage License Information

Before a marriage can occur in Tennessee, a license must be obtained from a County Clerk. Ministers of the Gospel, Rabbis, Christian Science practitioners, and various civil officials are authorized by law to solemnize a marriage.
Marriage license requirements are specific to each applicant's age. Please refer to the following guidelines:

18 Years of Age or Older

-Blood tests not needed
-No waiting period

-ID requirements:
One of the following: State certified birth certificate, Driver License, State Issued ID

-Identification guidelines for Legal Aliens who do not have a social security number:
1) Each with valid expiration dates: Passport and American Visa, or
2) Resident Alien Card

-Please contact your county for specific fees.

-You must know the following:
Parents full name (including maiden name of mother)
Parents state of birth and address (if living)
Applicant's number of prior marriages
Date last marriage ended (if applicable)

-A marriage license is valid for 30 days after issuance and may be executed outside of Tennessee. However, it must be returned to the issuing Clerk for recording and filing with the Tennessee Vital Records Office.

17 Years of Age

-Blood tests are no longer needed

-If applicant is 17 years of age, the other party has to be within four years their senior.

-Consent of parents, guardian, or next of kin (unless minor emancipated).

-Parent or guardian must accompany in applying for license. Custodial Parent must bring custody papers (if applicable) to show proof of custody.

-Identification guidelines for Legal Aliens:
1) Each with valid expiration dates: Passport and American Visa, or
2) Resident Alien Card
